Nepal has a uniform civil code operative since 1963, notwithstanding the fact that it is a multi-ethnic and multi-religious state. That this code is essentially a Hindu code is another matter, which will be discussed later further. No wonder therefore that the 1990 Constitution of Nepal (which stands abrogated) is silent on the issue of personal laws of different communities for the Constitutional Monarchical Kingdom of Nepal itself is ‘Hindu’ (Article 4). Indeed the Constitution also provides that ‘every person shall have the freedom to profess and practise his own religion as handed down to him from ancient times having due regard to traditional practices’. It may be argued that the 1990 Constitution may not have mentioned personal laws because the matter had already been settled through the enactment of the 1963 national legal code. A comparison with the Indian situation should clarify the point. The Constitution of India too guarantees freedom of conscience to all communities, yet advices the state to try to achieve the objective of a uniform civil code as contained in its Directive Principles of State Policy.

Each chapter of the book addresses a different issue, in the following format. First, it clearly and concisely explains the relevant law governing that issue. Then provides the relevant text of any statutes, Model Rules, sections of the Restatement of the Law Governing Lawyers, or other sources, with a link to an open-source versions of the full text, when available. It provides one or more heavily edited cases intended to illustrate the application of the law at issue, with a link to an open-source version of the full text of the case. Each case is preceded by a brief summary of its facts, reasoning, and holding, and followed by questions intended to indicate subjects for further investigation or discussion. This Minnesota-based project joins a worldwide effort seeking to ensure human rights for all. Raising Children With Roots, Rights & Responsibilities is designed for two-hour sessions. The curriculum can be adapted to any setting where families gather to learn. Such groups as Early Childhood Family Education (ECFE), parenting classes, child care centers, family child care homes, faith communities, YMCA/YWCA programs, Scouts/campfire groups, neighborhood and play groups, community schools, after school programs, and home schoolers can use this curriculum. This casebook features nearly sixty cases from American courts that involve, in some important way, religious belief and action. The book is divided into sections: First Principles, Establishment, Free Exercise, and Special Problems. Each section includes landmark or otherwise influential cases that have influenced American law and religious practice. Most cases come from the U.S. Supreme Court but the lower federal and state courts are also represented.
In the contextual introductions to each section and subpart, I have tried to give the reader a basis for understanding how the cases came about and why I chose them for this book. I have tried to minimize editorial comment. I have cited some scholarship where I think it would be helpful, but please do not mistake this as an attempt to produce a comprehensive treatise on the subject of religion in the law. It is a casebook, and a short one, all things considered. At the end of each introductory part is a short “further reading” list. I chose those articles because I found each of them interesting and useful to under-standing the topics that precede them. Their selection is not necessarily an endorsement of each author’s arguments, though I do agree with some of them.
I designed this casebook specifically for my own use in a 400-level undergraduate seminar called Law & Society. Class sessions using this book are intended to be student-led, roundtable talks with the professor acting as discussion prompter and neutral mediator. Generally, two cases are assigned for each class session. I selected, edited, and arranged the cases to complement each other thematically and chronologically to the best of my ability. Many of the cases include overlapping topics and could fit into multiple categories, so I took some liberties in their arrangement. Your mileage may vary.
